LEGAL SEPARATION

In some circumstances, an individual may desire to live separate and apart from his or her spouse, or the other spouse may have abandoned the family for a period of time.  When a divorce seems too far-reaching or is not desirable at the time, there is still a legal remedy available to provide for court orders regarding custody, visitation, child support, alimony (also known as spousal support), use and possession of property, and debt allocation.  A legal separation can provide these types of relief without terminating the marriage.

Although legal separations are very similar to divorce proceedings, they often provide time and space for parties to seek reconciliation while still ensuring that orders are in place to give structure and certainty to the issues most important to the family.  A legal separation can also provide for how the parties will handle the same issues in the event the relationship cannot be salvaged and a divorce becomes necessary.
